Infotel Terms and Conditions

1.
1.1 - This Contract is made between the Customer and the relevant hotel and not with Infotel who are the Hotelier’s Agent.
1.2 - These Terms and Conditions shall be incorporated into all hotel reservation bookings no matter how the same are made, i.e. whether by telephone, e mail or otherwise.
1.3 - No variation or modification to the Terms and Conditions shall be valid unless evidenced in writing and signed by a duly authorised representative of Infotel.
1.4 - Infotel warrants that it has authority to enter into this Agreement on behalf of the relevant Hotelier.
1.5 - The Customer acknowledges that this Agreement and these Terms and Conditions contain the whole agreement between the Client and the Hotelier and further that the Client has not relied upon any oral or written representations made by Infotel or its employees or agents.
1.6 - This Agreement supersedes any prior agreement between the Client and the Hotelier whether written or oral.
1.7 - In the event that any term or condition in this Agreement is declared by any judicial or any other competent authority to be void, avoidable, illegal or otherwise unenforceable the remaining provisions shall remain in full force and effect.
1.8 - This Agreement is governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this agreement shall be brought in a Court within England or Wales.
1.9 - Headings contained in this Agreement are for reference purposes only and shall not be incorporated into this Agreement and shall not be deemed to be any indication of the meaning of the clause and sub clause to which they relate.
1.10 - It is the Client’s sole responsibility to check and ensure that all booking details are accurate and correct. Infotel accepts no responsibility or liability for any discrepancies discovered subsequent to the booking being confirmed.
1.11 - Upon entering into this Agreement the Client consents to disclosure of information by Infotel to the Hotelier for the purposes of the Data Protection Act 1984 or subsequent enactments.
1.12 - All offers advertised on Infotel’s website or by its reservation staff are subject to availability, which varies from time to time.
1.13 - Any/all complaints relating to the nature or quality of the accommodation shall be made to the relevant Hotelier. In the event that the Client is not satisfied with the outcome of it’s complaint it should forward details to Infotel, who whilst not being responsible or indeed liable for the same, will endeavour to facilitate an amicable resolution as between the Client and the Hotelier at its discretion.
1.14 - Infotel acts as agent only. Each product (e.g. flight, hotel or car hire, etc) has its own price independent of any other products booked at the same time and creates a separate contract directly between you and the provider of that product. Travel bookings are ATOL & IATA protected.
2. Disclaimer
2.1 - Infotel does not make any representation or warranty as to the nature or standard of the hotel accommodation. The information contained within Infotel’s web site and on its call centre database is provided for illustrative purposes and Infotel accepts no liability for any loss whatsoever or howsoever as a result of any errors or inaccuracies contained therein.
2.2 - Infotel will endeavour to secure accommodation in a hotel specified by the Client but where there is no such availability Infotel will use its best endeavours to provide accommodation in a similar hotel of a similar standard in the specified area but accepts no responsibility should no alternative accommodation be available.
2.3 - Whilst Infotel will use its best endeavours to achieve the best rate for the Client during the period of its stay, Infotel does not warrant and shall not be responsible in the event that better rates could have been obtained.
2.4 - Infotel accepts no responsibility for any cancellation, alteration, curtailment or otherwise of any booking where performance is rendered impossible due to but not limited to an event of national emergency, war, prohibitive Governmental Regulation or any other cause beyond the control of Infotel.
3. Payment
3.1 - The Client agrees to make payment for the booking at such time and in such manner as shall be required by the Hotelier which will be notified to the Client by Infotel prior to confirmation of the booking.
3.2 - Failure by the Client to make payment at the time or in the manner required shall amount to a material and fundamental breach of this Agreement entitling the Hotelier to terminate forthwith without notice.
3.3 - In order to secure a booking the Client shall provide Infotel with all relevant credit card information that Infotel may require in order for this to be forwarded to the Hotelier.
4. Cancellation
4.1 - The cancellation policy of each hotel may differ and therefore the policy which relates to each booking will be notified to the Client by Infotel prior to the booking being confirmed and the Client agrees to be bound by such.
4.2 - In the event that the Client wishes to cancel a booking it must notify Infotel via a telephone fax or e mail and in the event that the Client does not receive any response from Infotel within 24 hours, it is the client’s responsibility to contact Infotel regarding the same.
4.3 - The Client acknowledges that in the event of a cancellation taking place outside the Hotelier’s cancellation period, he will be responsible for the appropriate cancellation charges arising there from.
4.4 - The Client further acknowledges that it will pay to Infotel an administrative fee of £10 for each reservation cancelled whether the same is cancelled within or outside the Hotel’s cancellation period.
4.5 - Infotel’s business hours are Monday to Friday 9.00 a.m. to 5.30 p.m. except on public bank holidays. If a Client wishes to cancel outside Infotel’s normal business hours or carry out any amendments to an existing booking it must do so in those circumstances direct with the hotel and inform Infotel of such changes.
4.6 - In order to avoid any disputes resulting from amendments or cancellations made by you direct with the hotel it is essential that you ask for an amendment or cancellation reference number which you should communicate to Infotel immediately either by fax, email, text message or by telephone the next working day.
5. Communications
5.1 - Telephone calls with Infotel may be monitored or recorded.
5.2 - E mail correspondence between the client and Infotel and any e mail booking request forms will be saved and may form part of this Agreement.

6. Force Majeure
Infotel accepts no responsibility for the cancellation, alteration or curtailment of any booking made as a result of matters beyond reasonable control, including but not limited to acts of God, natural disaster, fire and any other destruction of any accommodation booked, riots, acts of war or civil commotion, exercise of legislative, municipal, military or other authority, strikes, industrial action or any other reason beyond the control of Infotel.
